Article Abstract:

Companies offering their products and services think that by printing or uttering the words 'terms and conditions apply', they are no longer responsible to project the downside of the deal and can getaway with misleading advertising. A judgment passed by the Federal court suggested that the words 'terms and conditions apply' could not override a false representation that is boldly asserted.

Strong-arm tactics that once was an option for frustrated creditors but is no longer as Section 60 of the Trade Practices Act controls this aspect, which is enforced by the Australian Competition & Consumer Commission (ACCC). The ACC's Debt Collection and the Trade Practices Act aim at protecting harassment about debts.

Heal thyself: voluntary compliance is much better than prosecution

Article Abstract:

Voluntary codes of conduct succeed by keeping individual consumers and business customers happy through higher service standards, product quality and durability. Voluntary codes of conduct should be made as an integral part of fair-trading policy.
