The Accelerating Costs of Litigation

Article Abstract:

The cost and growth of corporate litigation are affecting corporate earnings. Corporations are turning to cost effective alternatives to litigation. One such procedure is the mini-trial. The mini-trial is a non-binding settlement procedure. Lawyers present summaries to executives in the presence of a neutral advisor. The executives then meet to negotiate an agreement. The mini- trial reduces costs, and duration of proceedings. Mini- trials provide confidentiality and a business, rather than a legal, solution.
