The learned intermediary doctrine

Article Abstract:

The responsibility of the medical equipment industry in making the intermediary (doctors and health professionals) learn the risk factors associated with the improper usage of the equipment, is discussed with the example of the Eleventh Circuit case that is filed with the U.S. Court of Appeals, on the usage of PCA pump (Patient Controlled Analgesic Infusion Pump). Courts discipline on the usage of warning labels on the products should be considered seriously by the manufacturers.

Article Abstract:

All milk producers are required under the Dairy Act to contribute a portion of their earnings to finance and administer promotional projects. The Cochrans, Brenda and Joseph, dairy operators from Westfield, Pa have successfully appealed against this in the Third Circuit Court of the U.S. Court of Appeals.
