The organization of relational contracts: the allocation of rights in franchising

Article Abstract:

The design of franchise contracts was analyzed to understand their internal logic and evaluate performance-contract structure relationships. Thirty franchise contracts were empirically examined to determine the effect of the contracts' internal organization on the expansion of franchising operations via new franchises and on the amount of dispute between the two parties involved in the franchise contract. Results proved that the various components of franchise contracts do allocate obligations and rights in different ways. Various dispute resolution mechanisms are more likely to be included as a contract becomes more relational.
