The insolvency of the grain miller, Water Wheel, provides a message to the non-executive directors that they must ensure that competent managers have briefed them completely on the companyEs financial position. They are not just figureheads and cannot be allowed by the court to defend themselves by saying that they were unaware about it. The Australian Securities and Investments Commission (ASIC) have provided a list of signs of insolvency and have launched a campaign against insolvent trading.

The advice trap

A uniform regulation of the financial services is recommended by the Wallis Committee report in 1997 that requires a license for those who give financial advices or deal in financial products. It is reported that thousands of non-financial sector businesses are caught because they are third party distributors of insurance and bank products.
