The Belgian Ministry of Economy has published a guideline note for transposing the European directive concerning electricity market liberalisation into Belgian law. A text is to be presented to the cabinet at the end of July 1998, with a view to a legislative bill. Three aspects are required for this liberalisation: a federal law, regional ministerial orders, and a region-federal cooperation agreement. The maximum electricity price will still be set by the Ministry of Economy. The Electricity and Gas Control Committee will be continued, by it will have a four-member board of directors, and a 28-member advisory council. All consumers are to have access to a liberalised market on 1 January 2010.

The Federation of Belgian large industrial energy consumers, Febeliec, has reacted to the proposals concerning liberalisation of the Belgian electricity market. First of all, it asks that the European directive be transposed into Belgian law before 19 February 1999. It also wants the rates to be transparent, reflecting underlying costs. It is demanding a consistent policy which does not affect the ability of its companies to compete, and it wants the market to be accessible to self-producers, including cogeneration installations. It wants a guarantee that the future network manager will be independent.

Jean-Pol Poncelet, the new Belgian Minister of Energy, intends to liberalise the electricity market in 1999 instead of 2000 as proposed by Elio di Rupo, the former Minister of Energy. Mr Poncelet intends to transpose the European directive concerning the liberalisation of the electricity market by 19 February 1999. At the start of 1999, the liberalisation of the Belgian electricity market will begin with industrial clients who consume more than 100 gigaWatt hours per year, and the liberalisation of the intercommunal market is not scheduled until 2007.
