Facilitating practices and the path-dependence of collusion

Article Abstract:

The impact of facilitating practices on the profitability of US industry is investigated using data from the 1930s. Analysis shows that the implementation of the National Industrial Recovery Act (NIRA) from Jun 1933 to May 1935 led to the effective legalization of price-fixing in many sectors. However, the analysis also provides evidence that only industries which allowed certain trade practices benefited from the legalized collusion of the period. Moreover, it is shown that the effects of collusion on price-cost margins persisted after the repeal of the NIRA.
