Issuing AIs during delay

Article Abstract:

The judgement in the case of Balfour Beatty Building Ltd. vs Chestermount Properties Ltd. alters the postition of architects who have to issue instructions while a contractor is in culpable delay. Prior to the case, contractors could claim new instructions had prevented the completion of the work within the agreed timetable. This removed their liability for liquidated damages. However, the ruling makes it clear that minor alterations issued after a period of delay do not alter the provisions of culpable delay.

The need to minimise risk on site

Article Abstract:

New regulations mean that architects must design buildings that are safe to build and maintain. These rules wil apply to projects from early 1994 and will affect projects currently at the design stages. The contractor will no longer be solely responsible for site health and safety and a planning supervisor should be appointed look after health and safety aspects of the design. The HSE will also publish a code of practice with the regulations.

The new Construction (Design and Management) Regulations 1994 (CDM) will soon come into force and projects to be affected will include nearly all construction works. The regulations will be phased in and each construction project will have to be assessed to determine which regulations will apply at different stages.
