Adjudication stays on track after contract repudiation

Article Abstract:

An arbitration clause survives a contract being repudiated and the same is equally applicable to adjudication. There is no limitation for starting adjudication, hence an adjudicator would have to take into account any valid limitation defense.

Unfair contract revision offers the chance to win back trust

Article Abstract:

Restricting liability to other party by the use of a capping figure would be unfair, within the confines of a contract. Many aspects in the construction industry could be potentially caught by the unfair legislation.
