Hospital's suit against insurer to proceed

U.S. Judge Thomas N. O'Neill has cleared the way for a lawsuit by Children's Hospital of Philadelphia against Independence Blue Cross, which is the region's largest insurance company. Children's Hospital, which is the largest pediatric facility in the region, has charged the insurer with listing the hospital in its promotional materials after a four-year contract had expired.

Open-heart surgery is increasing across southeastern Pennsylvania but patient safety is being threatened because surgeons are not accumulating enough operating experience to maintain their skills. With more hospitals performing cardiac surgeries, there are fewer patients per hospital and diminished opportunities for surgical practice.
