Article Abstract:

Estate and financial planning issues which have arisen in the late 1990s for bank and trust departments include lower trust income yields and IRA administration and taxation. Trust income beneficiaries have received lower distributions resulting from long-term investment strategies and other financial factors. Unitrusts and inflation-adjusted annuity trusts may be useful tools for remedying this situation. Banks have received new competition in the financial planning market due to Roth and IRAs which are not necessarily greatly profitable products for the banking industry.

Article Abstract:

Estate planning in the area of family limited partnerships (FLP) has been influenced by the IRS's disfavor of the FLP form of business structure. Valuation and characterization of property exchanges as completed gifts have been issues arising in the courts and IRS rulings. A separate estate planning method which may be useful for several reasons is creating grantor trusts which are intentionally defective.
