One individual is not a family for COBRA coverage

Revenue Ruling 96-8 indicates that a group health plan provider cannot charge the family rate when only one family member opts to continue group health coverage under the Consolidated Omnibus Budget Reconciliation Act of 1985. The Revenue Ruling discussed two situations where an employee and the spouse of this employee became ineligible in the plan. In the first situation, the employee and the spouse both chose to continue coverage and were charged 102% of the family rate. The IRS found this situation justifiable because the employee and the spouse fell in the family category. In the second situation, only the spouse elected to continue coverage and was charged 102% of the family rate. According to the IRS, this is not acceptable because the family group consists of two or more individuals. Therefore, the family rate was not the appropriate premium. The spouse should not have been charged more than 102% of the individual rate.
