Overcoming obviousness when patenting nanotechnology inventions

Article Abstract:

An attempt is made to show the nonobviousness of nanotechnology inventions when those inventions build on materials known in forms significantly smaller or larger than nano-sized. A patent may not be obtained though the invention is not identically disclosed o described as set forth in section 102 of this title.

Intellectual property (IP) rights includes the patenting of systems based information. The applicability as well as the degree of centrality of the knowledge to biological systems is both important considerations during the assignment of IP rights.
