Application of INS v. Chadha in the Context of the Reorganization Act of 1977
Article Abstract:
Employee Retirement Income Security Act (ERISA) standard administration in 1978 was given to the Internal Revenue Service (IRS). Fiduciary administration responsibilities were moved to the Department of Labor. At the same time, legislation effected a one-house veto. Due to a United States Supreme Court ruling involving the Immigration and Nationality Act and constitutionality of single house decisions, the Reorganization Act may be suspect on such constitutional grounds as well. The actions of the Supreme Court in INS v. Chadha are analyzed. Authority for the Reorganization Act probably expired in 1981. Severability was the fundamental text employed. It is quite possible that the unilateral veto included in the 1978 Reorganization Act is a violation of the United States' Constitution.

Paperless business: where are we now?

Business trends indicate that increasingly corporations are eliminating the use of paper in many business transactions through the use of electronic data interchange (EDI). Firms using EDI for sales operations, accounting, and purchases like it because it offers shorter ordering times, accurate shipping information, and reduced inventories. One specific application of EDI is electronic funds transfer (EFT), which is used instead of payment and receipt systems based on cash. Two popular EDI/EFT applications include ATMs and electronic tax filing. Managers need to keep abreast of technological innovations and need to be aware that as organizations automate, there are increased opportunities for white collar crime to occur, so monitoring of security measures is essential.
