An article on the effects of the US Supreme Court case Wal Mart Stores Inc. v. Samara Brothers Inc. on the concept of "trade dress" in trademark law is presented. The Court held that trade dress, the distinctive overall appearance of a product or service, is not protected unless registered with the US Patent and Trademark Office.
