Upper and middle-class families can receive income, generation-skipping, and state tax advantages by providing for wealth transfers to particular children through the use of Roth Legacy or Dynasty Trusts. Such trusts receive Roth IRA distributions and are similar in structure to testamentary trusts with particular children as beneficiaries. Reference to distribution analyses and examples may be useful.

The Roth IRA - a mid-year perspective
Article Abstract:
Estate planning practitioners have found by mid-1998 several factors which indicate which clients may benefit from conversions of traditional IRAs to Roth IRAs. Eight specific reasons which would encourage conversion include the availability to clients of tax benefit items such as credits and carryforwards, value of deferral, other estate plan funds, and choices regarding beneficiary designations.

The provisions of Revenue Ruling 2002-62 allow taxpayers to recalculate IRA payments without incurring tax liability and waive penalties when the funds in an IRA are exhausted. Although these rules provide benefits to many taxpayers, they also contain underlying provisions which may hurt taxpayers.
