Article Abstract:

The exact interpretation of building contract terms relating to the contractors' right of access to a site can be extremely complex. In some cases, access to the site or possession of the site can be hindered by the actions of a third party beyond the control of the employer, for example, and the employer is not normally liable in such cases. It can happen that the employer's obligations become unclear as a result of items in the specification or bills of quantities.

The acceleration of dilemma

Article Abstract:

In the building industry, if work on a building contract falls behind schedule, both employer and contractor may be forced to think of acceleration. Employers may worry about paying more if they instruct acceleration, while contractors must decide whether acceleration will save money. The pros and cons of acceleration are discussed.

The incorporation of quantities into construction industry contracts should be eschewed if confusion is to be avoided. Such information has a contractual meaning and specifications can be subject to adjustment, irrespective of whether the contract uses a JCT Agreement for Minor Building Works or an Intermediate form.
