A legal case heard in the UK courts confirmed a decision made by an adjudicator in the construction industry was enforceable. The main contractor, Pagehurst Construction, had been called upon by an adjudicator to pay its subcontractor, A and D Maintenance, its outstanding claim of 98,000 pounds sterling. Pagehurst tried to use the fact it was proceeding against A and D on a separate legal issue as a reason why the adjudication should not be upheld. They also claimed there was not a contract. The two firms had been carrying out renovation work on a school in Kent, England.

Article Abstract:
A case heard in the British courts dealt with a disagreement between a client and the contractor over the late completion of a new hotel. The dispute between contractors Henry Boot and clients Malmaison Hotel (Manchester) was over whether the delay in completion time was due to problems caused by both the employer and contractor. Malmaison had taken damages worth 250,000 pounds sterling. Malmaison claimed it was Boots own fault completion was late. The case was initially heard in arbitration before going to court where the judge dismissed Boot's claim.

It's all in the timing
Article Abstract:
Construction companies and those with whom they contract should agree beforehand about the acceptable circumstances and consequences for delays. Recent court rulings such as in the Malmasion and the Brompton cases raise more questions than they answer about the concept of concurrent delay.
