UK construction industry law stipulates contractors are legally bound to employers if a contract has been signed and agreed upon, even if some regulations within the contract may seem unfair. An employer may terminate a contract if contractors are deemed to have broken the legally binding agreement. The lack of provision for good faith is limited in UK courts, whereas European and American construction industry law allows for the use of good faith as a method by which a contractor may sue over unfair dismissal.

Article Abstract:
Construction industry contracts can be susceptible to the concept of repudiation, when sub-contractors are brought in by the builder to speed up or help out with work the main contractor cannot finish. Adjudicators need to have a full understanding of the legal implications of repudiation, otherwise a wrong judgment can be made in a dispute. Breach of contract is a viable reason for a firm to plead repudiation and discharge its involvement in the contract, yet still be paid for work undertaken.

The UK government is to introduce legislation to ensure small subcontractors are reimbursed interest on late payments, which will come into effect at the end of 1998. A law report is being written to present clear definitions of contractual and insurance terms, such as flood, which can relate to several different situations. Arbitrators must be seen to be totally unbiased, although they may have come across information which might cause a biased opinion.
