Judgment for international company in pharmaceutical trademark case
Article Abstract:
The Abu Dhabi Federal Court of Appeal in the United Arab Emirates (UAE) has upheld the decision of the Abu Dhabi Court of First Instance on a trademark infringement lawsuit filed by an international pharmaceutical manufacturer based in France against a UAE drug company. The appellate court considered the registration of the international firm's mark in 1989 as evidence of prior use of a trademark, and therefore an indication of ownership. Further, this trademark was not similar to the product that the local firm manufactured.
