Using U.S. provisional applications in your patent strategy

Article Abstract:

Many US firms who have developed proprietary technologies and products to satisfy the needs of international consumers are vulnerable to the patent infringement practices of unscrupulous competitors. Obtaining international patent protection has become a matter of being the first to file for a patent in countries outside the US and especially Europe. Companies might use the filing of US provisional applications to develop a more effective patent strategy.

Removing a hazard from the Internet freeway: the 1999 anticybersquatter law

Article Abstract:

This article examines a law that addresses problems associated with cybersquatting, or registering domain names based on trademarks for commercial use or resale. The new law gives the courts the authority to cancel and transfer improperly registered domain names and allows trademark owners to sue for damages.

On the wrong side of the trade dress divide

Article Abstract:

An analysis is presented on Wal-Mart Stores, Inc. v. Samara Brothers, Inc., regarding trade dress trademark law. The ruling against Samara Brothers is shown to be problematic, as it dictates that packaging may be inherently distinctive while product design may not.
