Broadening the scope of the Rehabilitation Act of 1973

Article Abstract:

The Americans with Disabilities Act of 1990 and the Rehabilitation Act of 1973 may cover discrimination based on obesity as evidenced by the US Court of Appeals for the 1st Circuit's decision in Cook v. Rhode Island. Both laws are intended to cover applicants who have one of a multitude of physical or mental disabilities. They provide for reasonable cost and safety limitations. The case's applicant had previously been employed at the same facility carrying similar weight and was denied re-employment based solely on her weight.
