Dismissal of antitrust suit upheld: collective negotiation of nonfee terms in provider contract found not to violate antitrust laws

Article Abstract:

Dentists should be careful when engaging in collective negotiations with a health care plan over its provider contract. The U.S. Ninth Circuit Court of Appeals upheld a district court's dismissal of an antitrust lawsuit against the Hawaii Medical Association, a consumer advocacy group, a physicians' practice group, and several individual physicians. They were charged with conspiring to fix prices and boycott a health care plan, even though they were negotiating non-fee items in the provider contract.

Court finds that RICO statute can be applied in noncriminal cases

Racketeers influenced and corrupt organizations act (RICO) not only can be approached for criminal settings but also for noncriminal laws. U.S. district court for southern district of Florida is dealing a case between the physicians and insurance companies.
