New York has some of the strictest rules compared with laws of other states regarding when an employee has grounds to proceed with a lawsuit against an employer. Experts and related authorities show concern regarding the issue stating it to be regrettable as a professional has to choose between employment and professional integrity.

The Utah Supreme Court, in its 3-2 decision, upheld CaliforniaEs Wrongful Life Act that prohibits someone from suing because they would have aborted a fetus if it were not for the act of omission of another person. However two of five justices stated that a claim tied to genetic counseling is really a medical malpractice case.
