Enforcement of self-referral ban delayed

Article Abstract:

The US Health Care Financing Administration (HCFA) postponed enforcement of Stark II, a new version of the law that bars physicians from referring patients to medical facilities in which doctors or their families have a financial interest. The postponement is caused by delay in computer programs and report forms plus the need for clarification of ambiguous areas in the law. Nevertheless, physicians may be prosecuted for violations of these laws, which are named after their author, Rep Pete Stark of California.

Mess for integrated delivery; Stark self-referral ban raises unexpected risks

Article Abstract:

A new statute, dubbed Stark II, expands the provisions of Congressman Pete Stark's law which outlaws referring patients to medical services owned by physicians and/or their associates. Numerous ambiguities and complexities in the new law raise concerns of hospitals and medical centers trying to organize integrated delivery systems. Lawyers who handle cases in health law raise questions about possible conflicts with, for example, physician ownership of hospitals.

It's time to cut self-referral ties

Article Abstract:

The American Medical Association (AMA) House of Delegates has approved a set of guidelines concerning physician self-referral. The new standards warn doctors from referring patients to medical facilities outside their practice if they have an investment interest in the referred facility. The AMA would like doctors to comply with the guidelines by 1995 and would like them to divest themselves of any financial arrangements that may violate the new guidelines.
