Subpoenas and science - when lawyers force their way into the laboratory
Article Abstract:
The Federal Rules of Civil Procedure should be amended to allow scientists to refuse to disclose information that would be detrimental to their research. These rules govern all civil trials in which people are subpoenaed to provide information, a process called disclosure. However, full disclosure might breach patient confidentiality or make it difficult for researchers to recruit patients for clinical trials. A scientist who is not directly involved in litigation should be allowed to refuse a subpoena without being charged with contempt of court.
