HIV testing without consent in critically ill patients

Article Abstract:

The concerns with nonconsented HIV testing among patients who are incompetent, risks future stigmatization for those found to be positive, and it fails the rare patient who values the avoidance of such testing over optimal care. It is suggested that state laws and laboratory policies should be modified or reinterpreted so that nonconcented HIV testing is allowed whenever the physician determines that tests for HIV infection and immune dysfunction.

CDC emphasizes that reactive rapid HIV tests must be confirmed with Western blot (WB) or immunofluorescent assay (IFA) , even if a subsequent EIA is non-reactive. All reactive rapid HIV test results require confirmatory testing.
