In the courts - material factor defence

Article Abstract:

The EAT (Employment Appeal Tribunal) ruling in the Ministry of Defense v Armstrong and others (7 April 2004) is presented. The contention of the nine female army officers who claimed that they were entitled to equal pay with male senior officers was upheld. The court also setout principles to understand the employer's defense in respect to the equal pay act in cases of indirect discrimination.

Homophobic abuse not discriminatory

Article Abstract:

A UK sexual harassment case about homophobic language is discussed. In Pearce v. Governing Body of Mayfield School, teacher Shirley Pearce claimed she was subject to sexual discrimination from the administration's refusal to deal with homophobic verbal abuse from pupils. The complaint was dismissed because the abuse was based on sexual orientation and not on gender.

Sexual orientation discrimination is sex discrimination

Article Abstract:

The United Kingdom's Employment Appeal Tribunal has ruled that discrimination based on sexual orientation is under covered under the Sex Discrimination Act: MacDonald vs. the Ministry of Defence.
