Article Abstract:

Insurers often insist upon policyholders using lawyers from their panel to provide representation during the course of court proceedings, whenever there is an accident at work. Although a panel lawyer is capable of representing the insured in many circumstances, there is a conceited view amongst insurers and policyholders that insurance companies are able to dictate who is to provide advice and representation to the policyholder.

The essential requirements for conducting a successful investigation include willingness to investigate, definition of requirements and criteria, preparation of incident response plan, preparing investigation accident plan and developing the readiness and initiative to conduct the investigation.

The impact of the new Construction (Design and Management) Regulations (CDM) to be introduced in 2006 is discussed. The new regulations will focus on the management of health and safety of the construction project from the initial design stage to the completion stage.
