Anticipation: waiting for the RTC and the FDIC to resolve the junior lien rights problems
Article Abstract:
The title insurance industry is still waiting, as of Apr 1, 1992, for the Resolution Trust Corp (RTC) and Federal Deposit Insurance Corp (FDIC) to issue their regulations regarding the rights of junior lienholders. The RTC and FDIC differ in their interpretation of what are called the Consent or Automatic Stay statute, 12 USC 1825(b)(2), and the Redemption statute, 28 USC 2410(c). The application of these statutes affects foreclosures and the status of liens.

The Dept of Housing and Urban Development has new rules, while the Federal Trade Commission has pursued rating bureaus into the US Supreme Court.
