Constructing protection for design professionals
Article Abstract:
Third-party lawsuits have escalated worker's compensation and general liability claim costs in recent years. Building design subcontractors are particularly vulnerable to such suits because anti-indemnification laws in many states prohibit agreements that transfer responsibility from subcontractors to contractors. Additional insured endorsements are of little use because general liability and workers compensation policies do not cover liability that results from design errors. What is needed is legislation that grants designers special immunity and allows them to be indemnified by contractors.

The primary topics at Coopers & Lybrand's Fourth Annual Executive Conference for property and casualty insurers were rate and solvency regulation, pollution and asbestos liability, worker's compensation and risk-based capital standards. Citing the high cost of Superfund, one executive suggested the implementation of a public fund for environmental cleanup and a 2% insurance surcharge to cover it. Another praised Texas and Oregon as models of worker's compensation reform.
