Article Abstract:
New Equal Employment Opportunity Commission (EEOC) regulations for mentally ill employees have opened new opportunities for insurers in terms of employment practices liability insurance coverage and risk management services. The guidelines basically require employers to accomodate mentally impaired workers who can perform the essential functions of their job unless such an accommodation would pose an undue hardship to the firm. The EEOC guidelines, however, do not define what constitutes essential functions nor undue hardship.

Mutual insurance companies have retained a substantial presence in several major markets worldwide today including the US. However, the appearance of new financial services competitors and the need to satisfy consumer demands are leading many mutual insurers to consider demutualization. While demutualization appears to be the trend internationally, mutual holding firms are increasingly becoming the more attractive alternative in the US.

An upside to downsizing

Brokers in the excess and surplus or E&S markets have capitalized on an increase in the proportion of new jobs created by small start-up firms that was directly related to the downsizing of five US corporations. The brokers developed a number of policies that enabled the small businesses to obtain required insurance coverage. E&S brokers cover unusually large or unique risks and those that are difficult to place.
