Corporate wellness programs can create new liabilities for workers' compensation insurance companies. Programs such as health clubs, athletic trainers and newsletters can transfer traditional healthcare costs to workers' compensation coverage. Wellness programs tend to focus on smoking, dieting and other general health information instead of focusing on workers' compensation issues, such as non-occupational and industrial injuries. No hard data exists proving the effectiveness of wellness programs on workers' compensation.

Time to capitalize on restructuring

Restructuring gives insurance companies an infusion of capital and increases their financial flexibility. However, companies need to assess the capital markets situation before they seek a major capital infusion from selling securities. Had Equitable Life Assurance Society of the United States opted to restructure to raise badly needed outside capital, it might be owned today by domestic policyholders and investors rather than a foreign company.

The insurance industry has an opportunity to turn the tide of punitive damages awarded to claimants by following a few basic rules.
