Civil justice reform in America: a question of parity with our international rivals
Article Abstract:
The recommendations of the Competitiveness Council for reforming American civil law should be adopted if they reduce litigation costs. There are many similarities in the proposals to the legal systems of Japan and Germany, such as a process for disclosure and restricted punitive damages. By making the legal system less friendly to litigation, business costs could be lowered and the American economy would benefit.

Many suggest changing the nature of discovery; debate heats up over the length, breadth and cost of discovery in big cases
Article Abstract:
The Judicial Conference of the United States is contemplating revisions in Federal Civil Discovery rules. Proposed changes in discovery rules would not take effect for several years if proposed and would first have to be reviewed during a public comment period. Ultimately the cost of discovery devices versus the evidence they produce is the tradeoff at issue in this debate.
