Huffcut v. McDonald's Corp should establish a precedent for whether employers are allowed to eavesdrop on workers' personal voice-mail messages. The case concerns workplace privacy and whether voice mail should be protected similarly to live telephone conversations under the Federal Wiretapping and Electronic Communications and Privacy acts. The ruling may prompt Congress to legislate on the issue.

The Fourth Amendment right of privacy and the exclusionary rule have been severely eroded by the 'war on drugs.' In four US Supreme Court cases, Illinois v. Gates (1983), U.S. v. Leon (1984), Illinois v. Rodriguez (1990) and California v. Acevedo (1991), the standard of probable cause was softened and the good faith exception to the exclusionary rule was adopted.
