Access to digital objects: a communications law perspective

Article Abstract:

A communicator's right to access digital objects may be needed as part of a body of law for the information superhighway. The national information infrastructure requires a legal environment in which services can thrive. Copyright protection for the contents of digital objects, packages of information stored in repositories for retrieval, need to be clarified. Legal issues surrounding privacy, retransmission and rebroadcast consents, common carrier regulation, and interception restrictions, must be resolved. For example, issues surrounding telephone company transmission of video were resolved in court.

Article Abstract:

Clients seeking relief for copyright infringement require precise legal analysis of the issues, looking beyond the particular technologies involved. Litigation of copyright issues on the information superhighway is likely to lead to statutory changes. In the Sony Betamax case, the US Supreme Court found no infringement in its recognition that this technological innovation could not be banned. Trademark and innocent infringement are intellectual property issues that may require resolution by litigation.

Copyright concerns on the information superhighway

Article Abstract:

Copyright laws that adequately protect digital objects transmitted on the information superhighway will have to be developed over time. There is little case law in this area, although the copyright law itself is flexible. The Working Group on Intellectual Property Rights believes the older body of law to be basically sound, but requires updating to cover transmission issues. Copyright infringement issues such as enforcement procedures and secondary infringer liability will require clear resolution.
