Addressing environmental disputes with labor mediation skills
Article Abstract:
A recent 1991-1992 environmental mediation case allowed the Federal Mediation and Conciliation Service to mediate something other than a labor dispute, but it also showed that labor mediation techniques can work for environmental mediation as well. The mediator encouraged the participants from several different groups to seek agreement by focusing on minor issues first and working into the more difficult issues when parties had invested time and energy into the proceedings. The mediator also made the parties work within a deadline, work on ground rules, examine changing political and economic conditions and analyze costs.

Improving your chance of success during construction mediation
Article Abstract:
There are several steps attorneys can take to insure a successful mediation of a complex dispute, such as in the construction industry. Attorneys should prepare to be flexible, but also to use their discovery and litigation skills. The parties must be prepared by helping them assess the value of mediating over litigating. Different types of settlements should be examined. A mediator needs to be selected and the cooperation of third parties obtained. Fact-based mediation, use of graphics and logistics, and pre-mediation exchanges should be evaluated.

Mediation: an answer to broker-customer disputes
Article Abstract:
The mediation between stockbrokers and their clients involves many steps which must be managed carefully to bring about a resolution of the dispute. Mediators must first gather information detailing the case in order to understand the parties and the story of their dispute. All proceedings must be kept confidential and any discussion of settlement amounts should be discussed in sessions in which the parties are not present together. Private and joint sessions need to be planned and managed differently.
