Airline breached pilots' seniority rights
Article Abstract:
British Airways (BA) breached its own pilots' employments contracts by granting higher seniority rights to the pilots of an airline it had purchased. The High Court held the BA pilots' contracts were unambiguous in defining new entrants and stipulating their seniority was to be determined by their date of joining the airline. The Court held this language included pilots who joined as a result of a takeover, so BA's recognition of seniority based on the pilots' service with their former employer breached the contracts of BA's existing pilots.

Human rights: bringing it all back home
Article Abstract:
The Human Rights Bill, introduced in 1997 by PM Tony Blair's government, is to incorporate into United Kingdom law provisions of the European Convention on Human Rights. United Kingdom citizens will increase their knowledge of their human rights and be able to enforce these in domestic courts rather than incurring the time and expense of going to the European Human Rights Commission and the Court in Strasbourg.

Pension rights excluded from transfers legislation
Article Abstract:
The UK High Court's ruling in the Adams case clearly resolves many issues concerning pension rights of transferred employees. The ruling holds that pension rights are excluded from the EC Business Transfers Directive and the related UK regulations are consistent with the directive. Only the pension rights accrued during actual service with the transferor employer require protection.
