Assisted reproduction and the frustration of genetic affinity: interest, injury, and damages
Article Abstract:
Increasing use of assisted reproductive technology (ART) to help infertile couples conceive brought a concomitant increase in frustrated genetic affinity. Genetic affinity entails the desire of most parents to have children with whom they share identifying traits. Denial of genetic affinity to users of ART due to breach of legal duty results in a cognizable injury. Analogizing this injury to wrongful pregnancy provides the best means of determining damages when genetic affinity is wrongfully denied.
