Businessman says he was plot's victim
Article Abstract:
Leonard M. Ross is suing the Santa Barbara News-Press and its owner, the New York Times Publishing Co, for libeling him in newspaper profiles published in Nov 1988 and Feb 1989. Ross was the subject of federal investigations in the early 1970s but was not suspected of investor fraud as the profiles claimed nor was he ever charged. Ross claims he has been subjected to undue scrutiny by both the press and government when he is only guilty of having chosen the wrong business partner, Barry S. Marlin, in 1969. The partnership ended in 1971 and several years later Marlin was convicted for defrauding investors.

D.C. court strikes EPA ozone rules; the 'American Trucking' decision may significantly curb U.S. agencies' abilities to make discretionary policy decisions
Article Abstract:
The US Court of Appeals for the District of Columbia Circuit ruled in American Trucking Ass'ns v. EPA that the EPA's ozone and particulate matter regulations represented an unconstitutional delegation of power. This regulatory regime came under the Clean Air Act, which directs the agency to establish limits on air pollution. This nondelegation issue may have a broad effect on the ability of agencies to make discretionary policy decisions. .

The 'Wilkow' decision
Article Abstract:
The ruling in Wilkow Forbes, Inc. that a libel case against a newspaper for criticism of one's business lacked a viable cause of action is discussed. Scathing criticism was not to be actionable because it was still opinion.
