CJRA speeded process but didn't cut costs
Article Abstract:
Rand Institute of Civil Justice studies of experimental plans under the Civil Justice Reform Act of 1990 suggest that these plans had little net effect on speeding up litigation, decreasing costs or improving attorney satisfaction with the process. The judicial control measures resulted in greater costs to litigants because the lawyers spent more hours on the expedited procedure. Increased use of judicial magistrates resulted in greater attorney satisfaction but did not expedite litigation. Other burdens on the courts overwhelm modest improvements in managing civil cases.

Systemic ways to speed up dilatory judges
Article Abstract:
Long-delayed judicial rulings are a frequent cause of court backlogs and an argument for formal systems to address the problem. The most basic reform should be to give chief justices more authority and responsibility to keep dockets current, in the public interest. In addition to active mgmt, new judges should receive relevant training, published statistics should cover all courts, and informal and outplacement counseling should be made available.

Judges playing stop the clock
Article Abstract:
Amendment of the Civil Justice Reform Act of 1990 (CJRA) would stop judges' relying too heavily on statistics in pursuing their work. The reporting period of the CJRA should be amended and the judge's delay rather than the attorney's should be reported. Before making decisions, judges should think whether they advance justice or are just made to control statistics. Attorneys should not hesitate to give their opinions.
