Cautiously confident; few taking advantage of year 2000 readiness law

Article Abstract:

Only a few corporations have availed themselves of the Year 2000 Information and Readiness Disclosure Act's window of opportunity in which to avoid liability for disclosing such information since the law was passed in fall 1998. Prompt, frank and complete disclosure of Y2K information without undue concern about lawsuits is the law's goal, and it applies to both federal and state Y2K claims. A retroactivity clause, as long as there is adequate notice to recipients of previous statements, provides a broad evidentiary exclusion of statements after July 13, 1998.
