Comparing apples to oranges: the need for a new media classification
Article Abstract:
A new media classification is necessary to establish the liability principles involving an information system company and its electronic databases. Cubby, Inc v CompuServe, Inc raised the liability issue because Cubby sued CompuServe for defamation for statements contained in one of the databases. The court held that CompuServe was a distributor with no control over content and therefore was not liable. However, the logic used by the court was based on many disparate cases and failed to establish a precedent for treatment of similar issues.
