Conflict, disparity, and indecision: the unsettled corporate attorney-client privilege
Article Abstract:
The scope of the attorney-client privilege when the client is a corporation remains uncertain. The Supreme Court determined that the 'subject matter' test was the correct one for the federal courts. Some state courts have rejected this test in favor of the less protective 'control group' test, while other states have yet to decide which test is the correct one. Companies doing nationwide business must take this lack of uniformity into account.

A study of the proposed "protective function privilege": compelliing Secret Service testimony
Article Abstract:
The author advocates the introduction of a 'protective function privilege' which could be invoked by government officials when the testimony of Secret Service personnel is requested if the matter in question arose while the Secret Service personnel were performing protective duties.

Following the psychotherapist-patient privilege down the bumpy road paved by Jaffee v. Redmond
Article Abstract:
The author criticizes the failure of the US Supreme Court in Jaffee v. Redmond to adequately define the extent of the psychotherapist-patient privilege. Inconsistent post-Jaffee decisions by lower courts on the privilege are analyzed.
