Equitable adjustments can remedy inequities among beneficiaries
Article Abstract:
Equitable remedies such as reimbursement may be available to address inequities in the distribution of property and of tax liabilities related to estates, but remedies should only be pursued when the inequities are substantial. Tax elections and other planning efforts can result in relative increases in the tax burden imposed on one beneficiary or on one class of beneficiaries. Accounting for administrative expenses can also impose inequities. In general tax burdens should be paired with tax benefits.
