Article Abstract:
The Australian High Court's decision in Bass v. Permanent Trustee Co. Ltd. regarding State Crown immunity under the Trade Practices Act is discussed. Issues include the question of whether the common law presumption that the Crown is bound by statute only where there is express mention or necessary implication is no longer an inflexible rule, and whether the court will revisit the principle in an appropriate case.

Debt collection and the Trade Practices Act
Article Abstract:
The Australian Competition and Consumer Commission's guideline on consumer debt collection and the Trade Practices Act is discussed. The Guideline contains 10 principles addressing issues in the consumer debt collection context. It prohibits corporations from using physical force, undue harassment, or coercion in connection debt collection.
