Consumer suits target prescription drug benefits; advocacy groups are seeking rights, information, recourse under state and federal laws
Article Abstract:
Consumer protection groups have filed suits on prescription drug benefits offered by managed care organizations. The wide media attention given the cost of providing pharmaceutical benefits and the increase in copayments requred by many managed care organizations and employer-sponsored health plans have made these suits possible. Moreover, Pres Bill Clinton has pledged to use part of the budget surplus to secure Medicare benefits for senior citizens and especially to ensure their access to prescription drugs. The visibility of the pharmaceutical benefit has also increased as managed care organizations have promoted drug coverage as a marketing tool.

Article Abstract:
The article argues that plaintiffs have increasingly used stockholder derivative actions to obtain legal remedy in reaction to the limitations on securities investor class actions imposed by the Private Securities Litigation Reform Act of 1995 and the Uniform Standards Act of 1998. The author discusses court rulings showing that investors will not easily be able to use this tactic to get around congressional reforms.

Issues concerning recommended changes in the sales tax system to adjust to the Internet. Uncertainty over how sales and other taxes should be applied to electronic commerce led to the Internet Tax Freedom Act in 1998, and rulings questioning the physical nexus paradigm presented earlier challenges.
