Criminal law; penalties for lying
Article Abstract:
Penalties for lying range from sentencing enhancements to contempt citations and the occasional perjury prosecution. Perjury prosecutions are hard to prove, so they are still relatively rare. Prosecutors must have evidence that the defendant swore to tell the truth in a federal case and then willfully stated or subscribed to a material matter not believed to be true. Plaintiffs with proof of the literal truth of their statements, even though these are nonresponsive and misleading, cannot be charged with perjury.

Drug dealer convicted in overdose death
Article Abstract:
Geneva Ray Talbert was convicted of felony homicide on Feb 10, 1992 in causing the death from drug overdose of a man to whom she sold cocaine. Virginia's felony homicide statute is controversial because it allows defendants to be convicted even if, as in Talbert's case, they were not present when the deceased person took the drugs and died. However, the conviction may not withstand appellate scrutiny due to the lapse of time between distribution of the drug and the death.
