Directive applied to transfer of assets of company in voluntary liquidation
Article Abstract:
The European Court of Justice ruled in Europieces S.A. v. Sanders that the EU's Business Transfers Directive applied to when a company in voluntary liquidation transferred all or part of its assets to another company from which the worker then took his orders, which the company in liquidation stated were to be carried out. Analysis of all aspects of the liquidation or insolvency procedure was necessary, in particular whether the business transferred continued to trade.

Overtime and rest-day working ban is a "strike"
Article Abstract:
The UK Court of Appeal held in Connex South Eastern Ltd. v. National Union of Rail, Maritime & Transport Workers that an overtime and rest-day work ban called by a trade union constituted a "strike" action. The court rejected the employer's contention that an overtime and rest-day work ban was an action short of a strike since it was not a stoppage of all work.
