Disaster; when it strikes, ADR can come to the rescue in resolving mass-tort claims
Article Abstract:
The Consumer Assistance Bureau of Florida's Department of Insurance received so many claims after Hurricane Andrew that it established the emergency rule creating "Alternative Procedures for Resolution of Disputed Claims from Hurricane Andrew." Homeowners in disputes with their insurance carriers over hurricane damage had the option of submitting their claims to mediation, and the American Arbitration Ass'n's regional office in Miami was appointed to administer the program. The program has become a model for other disaster-stricken states.

Reflections of a Dalkon Shield arbitrator
Article Abstract:
The use of dispute resolution as a vehicle for Dalkon Shield cases against the A.H. Robins Co provided claimants with a relatively inexpensive, fast way to resolve claims which had been pending for years. The program resulted from bankruptcy proceedings against the A.H. Robins Co, and claimants had the option of agreeing to settlement offers, a full-scale jury trial or arbitration, or a special type of less-formal arbitration called 'alternative dispute resolution'. This program will serve as a model for future mass-tort cases.
